Council set to take court action if travellers don't leave today

Cheshire East Council is set to go to court tomorrow to obtain a court summons so they can take repossession of land in Handforth.

Council officers served court papers on Friday, 6th December, to a group of travellers who set up camp on Earl Road nearly three weeks ago. However, they have still not moved on, so unless they do so today the Council will take court action tomorrow.

The travellers arrived on Tuesday 19th November, having moved two large tree stumps, which the Council had placed across the road, to gain access to the cul de sac.

Since then six caravans have been parked on the verge of Earl Road, adjacent to the Handforth Dean retail park.

A spokesperson for Cheshire East Council said: "Council officers served a court 'notice to quit' on the Travellers at Earl Road on Friday. As they still have not left, the next stage is to go to court tomorrow (Tuesday) to get an immediate repossession order. They will then have until midnight to leave."

"Because one of the Travellers, who is the driver of one of the vehicles, was ill and needed hospital treatment, a decision was taken by the judge to delay the court application until this Wednesday (December 18) to get an immediate repossession order. They will then have until midnight to leave."

perhaps they should have bolted the tree trunks down... or put up more than one barrier. tree stumps concreted into the floor? how about some particularly sturdy bollards? why not just shut the travellers in there and ensure they can't go anywhere else?

Am I the only person who now gets the urge to hum the Benny Hill theme tune whenever I hear of Cheshire East's latest action against illegal travellers?

It seems CE chase them all across the county in a snake like manner, shaking their fist at the travellers (no scantily clad women though, CE are far too PC for that), but they never actually catch them to administer any punishment or deterrent.

Instead, our community has to pay to clean up for their latest batch of fly tipping and for the associated legal fees, while our elderly and vulnerable pay dearly for their dodgy driveways and shoddy roof repairs.

It's a farce Benny would have been proud of, but like his comedy, few now get the joke.

@ Mark Goldsmith, Even Benny Hill got fed up of the same old material and tried something new...... eventually..!!!! .

The many previous threads on this subject demonstrate inefficiencies way past a humorous level,,, from our elected representatives; local council, wider Cheshire Council, PCC and law enforcement in addressing this continuing issue.

Simply put..... Is anyone who can do something about this actually really bothered?...... Do their actions speak louder than words ?..... Are our paid council tax resources being used to their best ability to resolve this..... (prevention, nipping in the bud as opposed to mopping up post event )... or is it merely pushed to the bottom of the “too hard to do” tray on some anonymous “jobsworths” desk.

The European Convention of Human Rights impacts on all aspects of UK legislation, resultantly authorities / law enforcement need to appropriately 'consider'; “the rights of others fairly”.

So in considering traveller rights fairly, remember to likewise consider the rights of residents. That quite clearly does not appear to be the case here. Motoring offences, criminal damage seems ignored.

Allow travellers to use the car parks at the authorities own many offices / premises across the county. Action to evict then would be significantly more swiftly enacted.. no doubt,,,. Then consider legislation, consider common sense, consider residents and consider how much more efficiently this needs to be enforced.... or prevented..... Better use of existing legislation by those enacting it is needed.

Listen to the voting public; protect them in their community.. Crime and Disorder Act 1998 (amended by the Police Reform Act 2002 and the Clean Neighbourhoods and Environment Act 2005) Community Safety legislation.....Travellers travel, Residents of Wilmslow reside.. Let’s also accommodate their respective needs in a fair and cost effective way.!

Are those in a position to do something about this actually doing their very best to represent the community ?........ Or are they Fred Scuttling about trying to explain their actions or lack of ... “Good evening viewers !!! ...” and there goes the Benny Hill music in the background again.......

Seeing that the land where the travellers keep coming to is soon to be developed why doesn't
The council dig a big trench across the road to stop them from parking there?

Cheshire East Council did go to court on Wednesday, 11th December, to obtain a repossession order but this was declined.

We understand this was because one of the travellers is believed to be unwell so a new court date has been set for 10am on Wednesday, 18th December.

That will be not too ill for hospital but too ill to sit in car then. What chance of them making a recovery by 18th? Not much I would say, so it looks like they will be there for another month then.

The question is why did it take over 3 weeks for CE to act on it initially.

i agree with Joanna Brandreth, good idea, but where will they turn up AGAIN next, they need to be fined to cover the cost of the clean up

how sweet that we give them time to move because one of them is in hospital who paid for that then?

The travellers at Earls Road were issued with the notice yesterday, and have been given until today to leave – due to the high winds and bad weather yesterday afternoon/evening.
